PIERRE, SD KELO.com — South Dakota legislators are advancing their investigation into alleged fraud cases at the state Revenue Department by seeking a subpoena to compel testimony from Revenue Secretary Mike Houdyshell, who has refused to testify.

Lee Schoenbeck, the Chair of the Legislature’s Executive Board, explained that while attorneys like Houdyshell may be restricted from discussing matters that could jeopardize a defendant’s right to a fair trial, this limitation does not apply to other legislators involved in the investigation.

In a unanimous vote this morning, the Executive Board decided to pursue the subpoena, emphasizing its necessity for developing policies to prevent future fraud cases within the department.

This move underscores the legislature’s commitment to transparency and accountability as they work to address the issues identified within the Revenue Department.
