ICE Arrests Emilio Jose Pena-Casilla for Serious Crimes Despite Bail Release

U.S. Immigration and Customs Enforcement ICE has arrested Emilio Jose Pena-Casilla, a 46-year-old Dominican national, for serious charges, including assault to rape, kidnapping, indecent assault and battery, and witness intimidation.

Pena-Casilla, who had been unlawfully present in the United States, was initially apprehended by U.S. Border Patrol in January 2023 for illegal entry near Eagle Pass, Texas.

He was placed in removal proceedings and enrolled in ICE’s Alternatives to Detention program but was released on his own recognizance the following day.

Despite multiple immigration detainers issued by ICE, Pena-Casilla was released on bail by both the Dorchester District Court and the Suffolk County Superior Court, where he faced charges related to serious sexual offenses.

ICE had requested that local law enforcement notify them before releasing him, but these requests were not honored.

Patricia H. Hyde, Acting Field Office Director for ICE’s Enforcement and Removal Operations ERO in Boston, emphasized the gravity of the charges and the importance of protecting community residents. Pena-Casilla remains in ICE custody as federal and local authorities continue legal proceedings.
